I understand that participation in boating and water-based activities involves inherent risks including but not limited to slips and falls, drowning, marine traffic, wakes, weather conditions, wildlife encounters, equipment malfunction, sun exposure, dehydration, and injuries during boarding and disembarking. I voluntarily assume all risks, known and unknown.
I certify that I am physically able to participate in and have no condition that would make participation unsafe. I am responsible for my own medications and acknowledge that no medical services are provided onboard.
In consideration for participation I release and hold harmless SonShine Adventures Boat Tours, its owners, captains, employees, and affiliates from any injury, loss, damage and death arising from participation, including claims of negligence to the fullest extent permitted under Florda Law.
I agree to indemnify and hold harmless SonShine Adventures Boat Tours fro any claims, damages, losses or legal fees resulting from my actions or participation.
I agree to follow all captain instructions, remain seated while vessel is in motion unless directed otherwise, wear life jackets when required, supervise minors at all times, avoid unsafe behavior, and consume alcohol responsibly. Failure to follow rules may result in termination of the tour without refund.
If the tour includes sandbar stops, swimming, or water entry, I acknowledge additional risks including eneven surfaces, submerged objects, marine life, currents, and boat traffic. I accept full responsibility for my decision to enter the water and agree to follow all safety instructions.
I understand that weather can change rapidly. The captain has full authority to cancel, delay, reroute, or terminate the tour for safety. Safety decisions are final.
Alcohol may be permitted for legal-age guests. Disorderly conduct, intoxication, illegal substances, or unsafe behavior will result in removal without refund.
I grant permission for Sonshine Adventures Boat Tours to use photos or video taken during the tour for marketing purpose unless written notice is provided prior to departure.
This agreement shall be governed by the laws of the State of Florida. If any portion is deemed invalid the remaining provisions remain in effect.
